 Conviction
 Fine  Prison Term  License Suspension  Upon Alternative 'Disposition' (MGL c.90, sec. 24D) 1st offender 'program' when no other dwi/oui within 10 years.
First Offense $500-$5,000 Maximum of 2.5 years 1 Year.

Hardship License: You are eligible to apply for work/school in 90 days; general hardship eligible after 180 days


Incarceration: none
Probation: unsupervised, attend 32 hours of driving classes

Fines: $750-$5,000

Hardship License: eligible within 3 days of entry into 'program'. This includes susension for chemical test refusal, and additional youth\ suspensions mandated by MGKL c.90, sec 24P.
Second Offense $600-$10,000 Minimum 30 days Maximum 2.5 years  2 Years

Hardship License: Work/education license considered after 6 months , general hardship after 1 year.
Upon Alternative 'Disposition': Incarceration: suspended sentence, entry into 'program' 14 days in 'hospital'

License Revocation: 2 years

Hardship License: Eligible to apply after 12 months
Third Offense (Felony) $1,000-$5,000 6 Months Mandatory, 150 days to serve Maximum 5 Years. No more than 2.5 years House of 5 years State Prison  8 Years

Hardship License: Work/education eligible in 2 years, general after 4.
 No Alternative Disposition
Fourth Offense (Felony) $1,500-$15,000 2 years mandatory, 1 to serve, not more than 2.5 years house of 5 years State Prison  10 Years

Hardship License: Eligible after 5 years for work/school, general in 8 years.
 No Alternative Disposition
 Fifth Offense (Felony) $2,000-$50,000 2.5 years House, 24 months to serve, 5 years State Prison

Lifetime

Hardship License: None
